1. Introduction
Welcome to DATE ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the DATE website and platform (collectively, the "Services").
Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

DATE is a platform dedicated to democratizing access to postgraduate education in Brazil through data analytics and transparency. Our Services include:

- Educational resources related to postgraduate education and affirmative action

Our platform is primarily designed for educational researchers, policy makers, university administrators, prospective students, and anyone interested in understanding and improving access to higher education in Brazil.
4. User Accounts
4.1 Account Creation

DATE collects, processes, and presents data about educational institutions, programs, and policies. This data is primarily collected from public sources and official institutional websites. We make reasonable efforts to ensure the accuracy and timeliness of this data, but we cannot guarantee that all information is complete, accurate, or up-to-date.
Users are encouraged to verify critical information directly with the educational institutions before making important decisions based on data from our platform.
As an educational research platform, DATE may use anonymized and aggregated data for research purposes, including academic publications, reports, and presentations. By using our Services, you acknowledge and consent to such use of anonymized data.

7.1 Our Intellectual Property
The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by DATE, its licensors, or other providers of such material and are protected by Brazilian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use. This license does not include:
- The right to reproduce, distribute, publicly display, or publicly perform the Services
- The right to modify, create derivative works of, or use the Services for any commercial purpose
- Any access to or use of our source code
For educational and research purposes, you may cite and reference data and information from our platform, provided that you properly attribute DATE as the source. For example: "Source: DATE - Data for Access to Education (date.edu.br), accessed [date]."

You represent and warrant that:

- All content you post is accurate and does not violate these Terms

10. Disclaimer of Warranties
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
While we strive to provide accurate and up-to-date information about educational programs and policies, we cannot guarantee the accuracy, completeness, or timeliness of this information. Educational institutions may change their programs, policies, and requirements at any time, and there may be delays in updating this information on our platform.
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

You agree to defend, indemnify, and hold harmless DATE and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.
13. Academic and Research Use

15. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the courts of São Paulo, Brazil, and you consent to the personal jurisdiction of such courts.
16. Consumer Rights

17. Severability
If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.
18. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and DATE regarding our Services and supersede any prior agreements, oral or written, between you and DATE.
