1. Introduction

Welcome to DATE ("we", "us", or "our"). These Terms of Service ("Terms") govern your access to and use of the DATE website and platform (collectively, the "Services").

Please read these Terms carefully before using our Services. By accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you may not access or use the Services.

2. Legal Framework

These Terms are governed by the laws of the Federative Republic of Brazil, including but not limited to:

  • The Brazilian Civil Code (Law No. 10.406/2002)
  • The Consumer Protection Code (Law No. 8.078/1990)
  • The Marco Civil da Internet (Law No. 12.965/2014)

DATE is a platform dedicated to democratizing access to postgraduate education in Brazil through data analytics and transparency. Our Services include:

  • Access to a database of postgraduate programs and affirmative action policies in Brazilian universities
  • Tools to compare programs by school, field, eligibility criteria, and equity policies
  • Data visualization and analysis features
  • Educational resources related to postgraduate education and affirmative action
  • Research tools and reports on educational equity and inclusion
  • Interactive dashboards showing trends in postgraduate education

Our platform is primarily designed for educational researchers, policy makers, university administrators, prospective students, and anyone interested in understanding and improving access to higher education in Brazil.

4. User Accounts

4.1 Account Creation

To access certain features of our Services, you may be required to create an account. When you create an account, you must provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You may be asked to provide information about your academic affiliation, research interests, or professional role. This information helps us tailor the experience to your needs and improve our Services.

4.2 Account Termination

We reserve the right to suspend or terminate your account and access to the Services at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users of the Services, us, or third parties, or for any other reason.

You may request the deletion of your account at any time by contacting us at support@date.edu.br. Upon account deletion, we will handle your personal data in accordance with our Privacy Policy and applicable data protection laws.

5. User Conduct

By using our Services, you agree not to:

  • Use the Services in any way that violates any applicable law or regulation
  • Use the Services for any harmful, fraudulent, or illegal purpose
  • Attempt to gain unauthorized access to any part of the Services or any system or network connected to the Services
  • Use any automated means to access or use the Services without our express permission
  • Interfere with or disrupt the Services or servers or networks connected to the Services
  • Collect or harvest any information from the Services without our permission
  • Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Services without our express written permission
  • Upload, post, or transmit any content that is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, or invasive of another's privacy
  • Impersonate any person or entity, or falsely state or otherwise misrepresent your affiliation with a person or entity
  • Engage in any activity that could disable, overburden, damage, or impair the proper functioning of our Services

6. Educational Data and Research

DATE collects, processes, and presents data about educational institutions, programs, and policies. This data is primarily collected from public sources and official institutional websites. We make reasonable efforts to ensure the accuracy and timeliness of this data, but we cannot guarantee that all information is complete, accurate, or up-to-date.

Users are encouraged to verify critical information directly with the educational institutions before making important decisions based on data from our platform.

As an educational research platform, DATE may use anonymized and aggregated data for research purposes, including academic publications, reports, and presentations. By using our Services, you acknowledge and consent to such use of anonymized data.

7. Intellectual Property

7.1 Our Intellectual Property

The Services and their entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by DATE, its licensors, or other providers of such material and are protected by Brazilian and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

7.2 Limited License

We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Services for your personal, non-commercial use. This license does not include:

  • The right to reproduce, distribute, publicly display, or publicly perform the Services
  • The right to modify, create derivative works of, or use the Services for any commercial purpose
  • Any access to or use of our source code

For educational and research purposes, you may cite and reference data and information from our platform, provided that you properly attribute DATE as the source. For example: "Source: DATE - Data for Access to Education (date.edu.br), accessed [date]."

8. User Contributions

Our Services may contain features that allow users to post, submit, publish, display, or transmit content or materials. Any content you post to the Services will be considered non-confidential and non-proprietary.

By providing any content on the Services, you grant us and our affiliates and service providers a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such content throughout the world in any media.

You represent and warrant that:

  • You own or control all rights to the content you post
  • All content you post is accurate and does not violate these Terms
  • The content does not infringe any intellectual property or other rights of any third party
  • The content does not violate any law or regulation

We have the right to remove any content that, in our judgment, violates these Terms or may be offensive, illegal, or violate the rights of any person or entity.

9. Third-Party Links and Content

The Services may contain links to third-party websites or services that are not owned or controlled by DATE. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You further acknowledge and agree that DATE shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services.

We strongly advise you to read the terms and conditions and privacy policies of any third-party websites or services that you visit.

10. Disclaimer of Warranties

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED OR ERROR-FREE, THAT DEFECTS WILL BE CORRECTED, OR THAT THE SERVICES OR THE SERVERS THAT MAKE THEM AVAILABLE ARE FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

While we strive to provide accurate and up-to-date information about educational programs and policies, we cannot guarantee the accuracy, completeness, or timeliness of this information. Educational institutions may change their programs, policies, and requirements at any time, and there may be delays in updating this information on our platform.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, DATE AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICES.

12. Indemnification

You agree to defend, indemnify, and hold harmless DATE and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including, without limitation, reasonable legal and accounting fees, arising out of or in any way connected with your access to or use of the Services or your violation of these Terms.

13. Academic and Research Use

DATE is designed to support academic research and educational purposes. If you wish to use our data or platform for academic research, please follow these guidelines:

  • Properly cite DATE as a source in your research publications and presentations
  • Do not misrepresent the data or present it in a misleading context
  • Consider sharing your research findings with us to help improve our platform

14. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Services after any revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, you are no longer authorized to use the Services.

15. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Federative Republic of Brazil, without regard to its conflict of law provisions. Any legal action or proceeding arising out of or relating to these Terms or your use of the Services shall be brought exclusively in the courts of São Paulo, Brazil, and you consent to the personal jurisdiction of such courts.

16. Consumer Rights

As a consumer, you have certain rights under the Brazilian Consumer Protection Code (CDC). Nothing in these Terms is intended to affect your rights under the CDC or other applicable consumer protection laws.

17. Severability

If any provision of these Terms is held to be invalid or unenforceable, such provision shall be struck and the remaining provisions shall be enforced to the fullest extent under law.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and DATE regarding our Services and supersede any prior agreements, oral or written, between you and DATE.
